Rare Torture and Law Book, Constitutio Criminalis Theresiana, 1769
Constitutio Criminalis Theresiana oder der Majestät Mariä Theresiä Erherzogin zu Österreich, u.u. peinliche Gerichtsordnung. Wien, gedruckt bey Johann Thomas Edlen von Trattnern 1769. Fol. with 30 (3 folded) coppers. 8 sheets, 282, LVI S. Ldr. d. Zt. with Rsch. and RVerg. (somewhat abraded and bruised; spine with laces). In German but with very impressive illustrations. Maria Theresia of Austria (13 May 1717 in Vienna; † 29 November 1780 ibid.) was a princess from the House of Habsburg. The Archduchess of Austria and Queen of Hungary (with Croatia) and Bohemia, who ruled from 1740 until her death, was one of the formative monarchs of the era of enlightened absolutism. She was mother of, among others, Joseph II, Roman-German Emperor and Marie-Antoinette of Austria-Lorraine, Queen of France. Known as the reformer among the Habsburgs, in 1776 she had introduced compulsory education in Austria and the hereditary lands and significant reforms of the judicial system occurred in her day, including the Constitutio Criminalis Theresiana, which for the first time was a uniform criminal law for all Habsburg lands except Hungary. In terms of content, it was entirely shaped by traditional law. Enlightenment and natural law did not yet play a role. It was not until 1776, under the influence of her son Joseph II, that torture was abolished.
