Scott Tyler (born 1965), known professionally as Dread Scott, is an American artist whose works, often participatory in nature, focus on the experience of African Americans in the contemporary United States. His first major work, What Is the Proper Way to Display a U.S. Flag (1989) was at the center of a controversy regarding whether his piece resulted in desecration of the American flag. Scott would later be one of the defendants in United States v. Eichman, a Supreme Court case in which it was eventually decided that federal laws banning flag desecration were unconstitutional. Dread Scott is a visual artist whose works is exhibited across the US and internationally. In 1989, his art became the center of national controversy over its transgressive use of the American flag, while he was a student at the School of the Art Institute of Chicago. President G. H. W. Bush called his art “disgraceful” and the entire US Senate denounced and outlawed this work. Dread became part of a landmark Supreme Court case when he and others defied the federal law outlawing his art by burning flags on the steps of the U. S. Capitol. He has presented at TED talk on this.
His work has been included in exhibitions at MoMA PS1, the Walker Art Center, Cristin Tierney Gallery, and Gallery MOMO in Cape Town, South Africa, and is in the collection of the Metropolitan Museum of Art, the Whitney Museum, The National Gallery of Art, and the Brooklyn Museum. He was a 2021 John Simon Guggenheim Fellow and has also received fellowships from Open Society Foundations and United States Artists as well as a Creative Capital grant.
In 2019 he presented Slave Rebellion Reenactment, a community- engaged project that reenacted the largest rebellion of enslaved people in US history. The project was featured in Vanity Fair, The New York Times, Christiane Amanpour on CNN, and highlighted by artnet as one of the most important artworks of the decade.
The artist Dread Scott, named himself after the famous American abolitionist Dred Scott. Below are more details about his namesake:
Dred Scott (c. 1799 – September 17, 1858) was an enslaved African American man who, along with his wife, Harriet, unsuccessfully sued for the freedom of themselves and their two daughters, Eliza and Lizzie, in the Dred Scott v. Sandford case of 1857, popularly known as the "Dred Scott decision". The Scotts claimed that they should be granted freedom because Dred had lived in Illinois and the Wisconsin Territory for four years, where slavery was illegal, and laws in those jurisdictions said that slave holders gave up their rights to slaves if they stayed for an extended period.
In a landmark case, the United States Supreme Court decided 7–2 against Scott, finding that neither he nor any other person of African ancestry could claim citizenship in the United States, and therefore Scott could not bring suit in federal court under diversity of citizenship rules. Scott's temporary residence in free territory outside Missouri did not bring about his emancipation, because the Missouri Compromise, which made that territory free by prohibiting slavery north of the 36° 30′ parallel, was unconstitutional because it "deprives citizens of their [slave] property without due process of law".
Although Chief Justice Roger B. Taney had hoped to settle issues related to slavery and congressional authority by this decision, it aroused public outrage, deepened sectional tensions between the northern and southern states, and hastened the eventual explosion of their differences into the American Civil War. President Abraham Lincoln's Emancipation Proclamation in 1863 and the post-Civil War Reconstruction Amendments— the Thirteenth, Fourteenth and Fifteenth amendments— nullified the decision. The Scotts were manumitted by private arrangement in May 1857. Dred Scott died of tuberculosis a year later.
